Guest Agreement with Us
Use of this web site constitutes your acknowledgement that you have read, and agree to, the terms and conditions of use presented herein. If you do not agree to any part of these terms and conditions, you must not access or use this site in any way.
Authorization to Contact – I authorize Sophisticated Travel, a part of Sophisticated Cruising LLC, an Arizona limited liability company, hereafter referred to as Sophisticated Travel, to contact me via telephone, email, or regular mail. I understand I may revoke this authorization at any time by notifying Sophisticated Travel in writing.
Deposits & Payments – A non-refundable deposit, partial payment or full payment may be required at the time of booking to hold your reservation. Special deposit and payment requirements apply to itineraries, and this information will be given on request at the time of booking. Final payment is due no later than 45 days prior to departure, unless required earlier by any supplier/vendor. Full payment is due at the time of booking for reservations made within 45 days of the date of departure. Payments received within 21 days of departure must be with Certified or Cashier’s check. Credit cards may not be third party. Regardless of whether Sophisticated Travel is the merchant on your credit card transaction, you agree to the following: Sophisticated Travel’s services consist of facilitating the sale and/or paying your suppliers, and once Sophisticated Travel provides said services, you agree not to dispute the credit card charge. If a supplier does not provide the service or ceases operations, your only recourse will be against the supplier. If a supplier goes bankrupt, your only recourse will be to file a claim with the supplier’s bankruptcy court. We also strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased.
Power of Attorney – As our client, you hereby appoint the us to be your attorneys-in-fact for the purpose of signing all documents necessary to purchase and issue airline tickets, tours, cruises, and hotel guarantees for late arrival. You authorize any of the attorneys-in-fact to sign credit card authorizations for said purchases whenever any of them receives an Internet booking request reasonably believed to be from you or someone acting on your behalf, requesting those tickets be charged to this credit card account. You agree that you will pay for all such purchases and will not hold us responsible for any of our actions pursuant to this power of attorney.
Non-refundable Reservations – Sophisticated Travel does not recommend its client purchase non-refundable/non-cancelable reservations. Non-refundable rates from airlines, hotels and other suppliers frequently can offer a significant savings to a client. However, Sophisticated Travel strongly cautions client to select fares or rates that allow for modification and/or cancellation, even if it includes a change/modification fee. Client understands and acknowledges that if any portion of the itinerary is identified as “non-refundable,””non-cancelable,” or uses other similar terms, than if client should change or cancel the reservation, the original payment will be forfeited. Further, if client requests Sophisticated Travel to purchase reservations with “non-refundable,” or “non-cancelable” rates from its suppliers, Client understands Sophisticated Travel will use its best efforts to obtain those rates. However, if those rates are not available at the time of booking, client authorizes Sophisticated Cruising to make other arrangements as is appropriate. Sophisticated Travel recommends all clients consider travel protection insurance.
Cancellations & Modifications – A service charge of $50 per booking will apply for each change made after the initial booking request has been confirmed. Your itinerary may be subject to cancellation and/or change/modification policies and fees from airlines and other suppliers, which will be passed on to you or charged directly to your credit card by the supplier. By making a deposit, you are accepting the cancellation policies of each supplier and waive any recourse against Sophisticated Travel. Credits/refunds are not guaranteed due to global events, pandemics, or acts of God. Once travel has commenced, any changes or cancellation will be at your own expense. Special cancellation and modification policies apply for itineraries including cruises, hotels during holiday or special periods, and some promotional airfares. Information will be given on request at the time of booking.
Travel Protection Plan – Sophisticated Travel is proud to offer our clients an option to help cover your travel investment through travel protection plans. Sophisticated Travel strongly urges its clients to purchase travel protection insurance to protect again unforeseen problems. For more details and inclusions/exclusions, please see the “Description of Coverage” provided by the travel insurance company. The Sophisticated Travel is not authorized to offer advice or answer questions about travel insurance coverage questions and any comments provided should not be relied upon by Client. Only the travel insurance provider can answer coverage questions.
Supplemental Price Increases – Travel arrangements are subject to additional fees and supplemental price increases that may be imposed by the supplier (airline, cruise line, hotel, etc.) and/or governmental entity after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and that you may be bound by those contracts regardless of whether you receive notice of their terms. NOTICE: Hotels may add additional fees including but not limited to, resort fees, parking fees, local taxes and service fees which are not disclosed to Sophisticated Travel and which are applied to Clients account.
Prohibited Items Aboard Aircraft – Federal law forbids the carriage of certain hazardous materials, such as aerosols, fireworks, and flammable liquids aboard the aircraft. If you do not understand these restrictions, contact your airline or go to the federal government’s “Pack Safe” website for details.
Documents Required – U.S. citizens must have a valid passport valid for six months from the travel return date. Citizens of other countries should consult the appropriate Consulate or Embassy office in their own country. It is solely the passenger’s responsibility to ensure that all documents needed are complete and current. International tickets cannot be issued until we receive a copy of the Name Page of the passenger’s passport. Visa’s may be required for entry certain countries as well as proof of vaccinations. Client is solely responsible for obtaining a valid passport and any required visas and any health certificates.
Supplier “Terms & Conditions” – Typically each vendor or supplier will have their own “Terms & Conditions” or a similar type of document outlining their terms of service, liability, responsibilities, limitations, cancellation policies, etc. You are responsible for reviewing each supplier’s contract, and your acceptance of this document shall constitute your acceptance of each supplier’s contractual terms.
Pricing – All prices quoted by Sophisticated Travel are in U.S. dollars and include costs associated with planning, communication, and documentation. According to industry standards, package prices are not subject to an itemization of costs. For travel in countries not using the U.S. dollar, prices have been calculated based on tariffs and current exchange rates. Prices may be subject to change in the event of significant currency fluctuations, the introduction of new taxes, and/or fuel surcharges up until final payment is received. Once final payment is received, all prices will be guaranteed.
Not Included – Except where specifically indicated, meals, beverages, laundry, excess baggage charges, and any items of a personal nature, including the cost of passports and visas, are not included. U.S. Departure Tax and U.S. Federal and Agricultural Inspection Fees, are not included and are subject to change. Local accommodation or visitor taxes, if any, are not included. Unless explicitly stated in the travel documents, local transportation, round trip hotel transfers, and baggage handling are not included. Hotels offering complimentary equipment and activities are subject to availability. Sophisticated Travel reserves the right to change the itinerary sequence and properties when necessary. Air-inclusive and cruise packages may include fuel surcharges. Fuel surcharges are subject to change.
Acceptance of Terms & Conditions – The payment of the deposit, or any partial or full payment for a reservation, shall constitute your agreement to all provisions stated in this “Guest Agreement with Us,” including the cancellation terms and policies.
NO WARRANTIES – THE CONTENT, CODE, ACCESS, AND OTHER FEATURES OF THIS SITE ARE PROVIDED “AS IS”AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF ACCURACY, RELIABILITY, MERCHANT ABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY SUCH FEATURES WILL OPERATE UNINTERRUPTED OR IN AN ERROR-FREE FASHION, THAT DEFECTS \WILL BE CORRECTED, OR THAT THIS SITE OR THE SERVER ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. APPLICABLE LAW MAY NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
NO CONSEQUENTIAL DAMAGES – IN NO EVENT WILL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS AND COST OF PROCUREMENT OF SUBSTITUTE PRODUCTS, ARISING OUT OF YOUR USE OR INABILITY TO USE ANY CONTENT OR FEATURES, OR YOUR FAILURE TO ACCESS OR CLICK-THRU ACCESS ANY CONTENT OR FEATURES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION AND EXCLUSIONS MAY NOT APPLY TO YOU.
Travel Disclosure, Waiver and Release – In offering this transportation or any other travel arrangements for sale, Sophisticated Travel acts only as an agent. Sophisticated Travel maintains no control over the personnel, equipment or operations of any supplier and assumes no responsibility for, and shall not be expected, asked or required to pay for any financial loss, personal injury, death, emotional distress, sickness, illness, quarantine, accident, expense, defect, property damage, delay, inconvenience, any other loss, or irregularity which you may experience either by reason of: 1) nonperformance by any supplier for whatever reason; or 2) wrongful, careless, negligent or unauthorized acts or omissions on the part of any supplier or its employees or on the part of any other party not under the control of Sophisticated Travel; or 3) any defect, breakdown or other failure of any aircraft, train, automobile, ship, accommodation or other equipment or instrumentality owned, operated or otherwise used by a supplier; or 4) any damage, loss or delay due to labor disputes, machinery and conveyance breakdown, acts or re-routing by governmental or other authorities, weather, omissions, or other causes beyond Sophisticated Travel’s control.
Sophisticated Travel reserves the right to substitute hotels of a similar category or change schedules without prior notice should circumstances so require. Photographs provided to the client come from Suppliers and 3rd party sources, and Sophisticated Travel makes no representations or warranties, express or implied, regarding these photographs, nor about the services provided by a Supplier nor the condition of their properties.
Client expressly releases Sophisticated Travel from all liability whatsoever for injury to a person(s), property, or any other losses covered in the paragraphs above. It is further acknowledged that this document is contractual and not merely recitals. This document applies to the client, and all members of client’s party or listed on the itinerary. Client agrees to provide copies to other members in client’s party.
Availability of refunds for unused travel reservations will vary with the type of reservations and the point at which reservations were not used. Please note that when you purchase travel services, your money immediately belongs to the supplier. In the event of any supplier bankruptcy, you should seek refunds directly from the supplier or bankruptcy court. Trip cancellation and trip interruption insurance are available at an additional cost to protect you from certain unexpected events. The terms of insurance coverage are controlled by the actual insurance policy issued. Sophisticated Travel strongly recommends that all insurances offered or recommended by your travel agent(s) be seriously considered and will assist in purchasing such insurance upon request.
Sophisticated Travel has no special knowledge regarding the financial condition of the suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For information concerning possible dangers at destinations, Sophisticated Travel recommends contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov. For medical information, the Sophisticated Travel recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel.
You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). You hereby release Sophisticated Travel from all claims arising out of any problem covered in the paragraphs above. You agree that the courts in Maricopa, Arizona, will be the exclusive jurisdiction for all claims brought by you or Sophisticated Travel, and you hereby submit to the personal jurisdiction of those courts.
If any provision of these terms and conditions is found to be unenforceable, such provision shall still be enforced to the fullest extent of applicable law and shall not affect the enforceability of the remaining provisions.
The foregoing terms and conditions represent the entire agreement between you and us.
